A businessman from Chekhov urban district managed to avoid a large fine after contacting the public reception of the Regional Business Ombudsman.
Thanks to the head of the public reception office of the Regional Business Ombudsman in Chekhov district, the activity of a cafe finally has not been suspended.
An individual entrepreneur will pay a fine of 5 thousand rubles and eliminate the violations identified by Rospotrebnadzor as soon as possible.
In the course of the inspection, carried out by the Serpukhov territorial department of the Rospotrebnadzor in Moscow Region, for a cafe operating "take-away" on the territory of Chekhov, violations of the mandatory requirements established by federal and municipal legal acts were revealed. In particular, a specialist from Rospotrebnazor found that the requirements established by Federal Law No. 52-FZ of March 30th of 1999 "On the sanitary and epidemiological well-being of the population", SanPiN 2.3 / 2.4.3590-20 "Sanitary and epidemiological requirements for the organization of public catering of the population were violated. ", - that was said in the inspection report.
According to the head of the public reception office of the Moscow Region Business Ombudsman in Chekhov urban district, Sysoev S., who participated in the unscheduled on-site inspection of Rospotrebnadzor, when inspecting the premises of the cafe, the features of the profile specifics of the work of this public catering facility were not taken into account. In the cafe located on the federal highway and working only for the delivery of ready-made and packaged meals, there are no seats for eating.
“When conducting an inspection and making a decision on the punishment for a detected violation, in my opinion, it is necessary to take into account the specifics and circumstances, including the level of profit of the inspected object.
Suspension of activities is always usually the closure of a business. In this case, the result of the check, which was carried out by the territorial department of Rospotrebnadzor, could be a fine of 50 thousand rubles and even the suspension of the cafe, but due to the fact that the Rospotrebnadzor specialist was given appropriate explanations in time (including regular buyers of finished products, who noted excellent quality of food) the punishment was changed to more adequate sanctions - a fine of 5,000 rubles and elimination of the revealed violations as soon as possible, agreed with the entrepreneur, ”said Semyon Sysoev, head of the public reception office of the Business Ombudsman of the Moscow Region in Chekhov, about the results of the audit.
