The Moscow Business Ombudsman helped the entrepreneur to repay the million-dollar debt under the executed contract.
It took the company from Balashikha city district six months to get paid for the maintenance services provided for the equipment of two Yaroslavl thermal power plants.
Only after contacting Vladimir Golovnev, the Commissioner for the Protection of the Rights of Entrepreneurs in the Moscow Region, the funds were credited to the organization's account.
In June 2021, the Balashikha enterprise won the tender and concluded a corresponding contract with a thermal power company. The services were performed in full, but the payment from the customer was only 35%. Out of 1.64 million rubles, only 580 thousand were transferred to the organization's account.
Official correspondence with the customer did not bring results, numerous letters remained unanswered. The inaction of PJSC "Territorial Generating Company No. 2" caused the company to fail to fulfill its obligations to other customers. As a result, the company's management turned to the Moscow Business Ombudsman to protect their rights and legitimate interests.
"We are an SME entity. This installment makes it impossible for our organization to make salary and tax payments in full, as well as to ensure the fulfillment of newly concluded contracts, since all contracts are postpaid," the entrepreneur wrote in his appeal.
Having taken into account the applicant's arguments, Vladimir Golovnev sent relevant requests to the heat and power company and the Prosecutor's Office of the Yaroslavl region. A few days later, the head of the organization informed the Commissioner that the debt for the services rendered had been fully repaid.
