The manufacturer failed the supplier, he did not fulfill his obligations to the state customer. 

The situation threatened to turn into a multimillion-dollar fine for him. Appeals to different instances did not give results. And the businessman turned for help to the Commissioner for the Protection of the Rights of Entrepreneurs in the Moscow Region.

A meeting of the Expert Council working group was organized on this appeal, during which the circumstances of the case were considered and arguments from all parties were heard.

A contract for the supply of server equipment was signed between an entrepreneur from the Khimki city district and Mosoblgaz JSC. However, due to the terms of delivery of the goods violated by the manufacturer, the entrepreneur was unable to fulfill the obligations under the contract within the established time. In this regard, the joint-stock company demanded that the entrepreneur pay penalties.

As a result of the group meeting, ways to resolve the issue were outlined. In particular, a proposal was made to replace the server equipment with another improved characteristics. To do this, the entrepreneur must obtain the appropriate conclusion of the distributor and submit it to the Mosoblgaz JSC commission for approval on amendments to the current contract. The parties have determined a reasonable time frame for the preparation of the necessary documents. Until the completion of the process, the issue remains under the control of the Commissioner.
