An individual entrepreneur engaged in cargo transportation appealed to the Commissioner for the Protection of the Rights of Entrepreneurs in the Moscow Region, Vladimir Golovnev with a complaint about the inaction of the police during the investigation of a criminal case.
In August 2022, an individual entrepreneur received an application for the transportation of cargo worth more than 6 million rubles from the Moscow region to the Irkutsk region. Due to his busy schedule, he attracted a third party to fulfill the order, which he found through an electronic application on the Internet. According to the contract, the cargo was supposed to be delivered to the destination within 10 days, but this did not follow. The hired driver did not get in touch.
The entrepreneur wrote a statement to the police, on the basis of which a criminal case was initiated on the theft of property. But the investigation of the case has been suspended due to the failure to identify the person to be brought as an accused.
After unsuccessful attempts to restore his violated rights, the entrepreneur turned to the Commissioner Vladimir Golovnev for help.
At the request of the Business Ombudsman, the Main Directorate of the Ministry of Internal Affairs of Russia for the Moscow Region and the Prosecutor's Office of the Moscow Region conducted inspections, following which, in March of this year, the police decision to suspend the investigation of the criminal case was canceled.
Currently, the necessary investigative actions and operational search measures aimed at establishing all the circumstances are being carried out in the criminal case.
According to the facts of the revealed violations of the criminal procedure legislation, including red tape, committed during the investigation of a criminal case, the head of the Main investigative department of the Ministry of Internal Affairs of Russia in the Moscow Region submitted an idea on their elimination and bringing to disciplinary responsibility of the guilty officials.
