Another municipal contract was successfully paid after intervening in the case of a business ombudsman near Moscow

A limited liability company concluded a contract with the Municipal Unitary Enterprise of the city of Vidnoe for the supply of electrical equipment from last November. The goods were delivered on time, but payment for the executed obligations to the company's current account was not received.

In March of this year, the General Director of the Company, in order to protect his rights and legitimate interests, appealed to the Commissioner with a complaint about the inaction of the municipal unitary enterprise “Vidnoe Municipal Economy Production and Technical Association” to pay its debt on the executed contract.

Having considered the applicant's arguments, Vladimir Golovnev sent the appeal materials to the Main Control Department of the Moscow Region for their inspection. According to the applicant, on March 28, 2019, the Municipal unitary enterprise Vidnoe MEPTA asked him to withdraw the complaint from the ombudsman, promising to pay the debt in full.

It should be noted that earlier the Main Control Department of the Moscow Region had already initiated an administrative offense case against the General Director of the Vidnoe MEPTA based on Part 1 of Art. 7.32.5 of the Administrative Code of the Russian Federation for violation of the goods (works, services) payment deadline and procedure in the implementation of procurement to meet state and municipal needs.

According to part 2 of the Article, the Commission of an administrative offense, mentioned  by part 1 of this article, by an official who was already convicted  to administrative punishment for a similar administrative offense, requires disqualification for a period of one to two years.

As a result of the assistance provided, on April 1, 2019, the debt payment in the amount of 1,034,676.84 rubles was received in full and the topic was removed from the control of the regional business ombudsman.
