The criminal case against a businessman from Naro-Fominsk was discontinued, but his business got completely broke. In January-March 2019 in the city court of Naro-Fominsk the Commissioner’s representative, along with a lawyer, took part in the defense of the General director of Alliance LLC, accused of committing a crime under Part 4 of Article 159 of the Criminal Code.

General director of Alliance LLC Yaroslav Ogrenda  was charged with major fraud after he had fulfilled a municipal contract to repair four roads in the city of Aprelevka of Naro-Fominsk Municipal District for a total amount of more than 5 million 800 thousand rubles in 2014.

According to the investigators, while carrying out this contract, the company overestimated the actual work costs and used cheaper materials than it had been indicated in the terms of reference. At the same time, there are no complaints against Alliance LLC from the Aprelevka administration regarding the quality of the repairs made.

Seven companies took part in the tender, Alliance became its winner. The initial value of the contract was determined by the administration of more than 8 million 770 thousand rubles.

The trial, which was attended by the Commissioner’s representative and lasted more than two years, ended on March, 25 of this year. Due to the revealed violations in the criminal prosecution procedure, together with numerous procedural violations committed by the Prosecution, the criminal case was returned to the Naro-Fominsk District Prosecutor’s Office for additional investigation.

The court also revealed a biased attitude from the Police side which became the reason for the fact that the investigation was obviously accusatory in nature, and ruled that Jaroslav Ogrenda was not guilty of the incriminated accusation.

As a result of the Police actions the businessman ceased his business activities completely.
