Business under reinforced concrete pressure

The specific structure of the building nearly became the reason of imminent business closure. But obviously the negative impacts were avoided due to the fact that The Business Ombudsman in Moscow region Vladimir Golovnev supported a company owner in Bogorodsky urban district. Thus this intervention could prevent further long court proceedings.
In last October there was an exceptional check in a food store provided with ‘no warning mode’ by inspectors of the State Building Supervision in Moscow region. They checked construction works being performed inside the store building for compliance with the technical regulation requirements and project documentation.
This building was built in early 1990-th and apparently has its own design characteristics. Exactly it became the reason of emerged conflict situation: during this inspection the supervisors mistakenly revealed an installation of reinforced concrete constructions without planning permission (in violation of the requirement of article 51 of City Planning Code).
The supervisors issued a controversial report and submitted it to the City Hall. The city authorities organized their own investigation, which mistakenly reconfirm controversial findings made by the State Building Supervision. The only expected result for the business would be a mandatory closure.
With the object to approve the investigation results and to issue an order of mandatory demolition the administration of Bogorodsky urban district filed a lawsuit in Noginsk city court.
The defendant party requested the business ombudsman to intervene into the lawsuit as the third party. The intervention played a role of a balance in the court and the interests of the defendant were fully protected.
During the judicial hearings held in the end of May the local authority had actually dropped the case and exited from the lawsuit. Eventually the lawsuit was considered without consequences and therefore dropped (article 222 of Civil Procedure Code of Russian Federation).
