When public bodies run things with no agreements…

A simple transferring of  incorrect data from Pension fund to Tax service has caused for an entrepreneur from Domodedovo some embodiment of the Krylov fable  “A swan, a lobster and a pike”, as long as the regional business ombudsman Vladimir Golovnev had to intervene into this matter. 

It took him not so much time to resolve long-running case for the benefit of business owner.

In March 2017 the current bank account of the owner was emptied for nearly RUR 150 000  and had been blocked due to the collection order issued by tax authorities of Domodedovo urban district. The businessman was told he did not provide the tax declaration for 3 years, so the taxes, fines and fees were imposed on him.

Having, however, submitted information to the Pension fund office always in time and fearing for his reputation to be ruined, the entrepreneur unexpectedly understood that a computer program failure was at the origin of his issue.

Seemingly, it is quite easy to fix technical error and let the businessman continue working.  But the process, once begun, was not going to end: the entrepreneur had to work as a courier for two  authority at once to gather data and deliver it by himself from pension fund to tax service and back again.

-Instead of doing my business that  I paid taxes and fees for , I had to work as a  courier for two years. But my account remained  blocked. As a consequence I was made to discontinue and suspend the activities with transportations- indicated in his appeal  the entrepreneur.

 Without any hope for justice, the entrepreneur requested  the Business Ombudsman in Moscow region Vladimir Golovnev to intervene into this case with the object to protect his interests. The regional department of tax service was also connected to solution to the issue.

Been properly consulted by the ombudsman’s office the plaintiff had appealed for a refund request to get overpaid fees and taxes reimbursed. The exact amount was calculated in April this year and already in the end of May all the money were transferred to the businessman’s current account. Anyway, during prolonged proceeding the company had had been closed.

-The accounts freezing usually lead to business destruction, so there should be an extraordinary case this action to be engaged against the business. Recalling the survey of business networks, every fifth entrepreneur faced with a problem of account blocking last year, and 43% of them could not get over it,- said Vladimir Golovnev. –there must be thoughtful risk-based management in every directions, inevitably including personal responsibility for the officials, making technical mistakes, to undo the damage  and let business carry activities out.
