The Moscow region human rights activists were briefed of alternative way to resolve conflicts.
A special workshop of pre-judical dispute settlement was held in the Moscow Region Government House. The actual lawyers and heads of business ombudsman public receptions informed the participants of what kind the opportunity for entrepreneurs a mediation provided. Based on the principles of voluntariness, confidentiality and impartiality the mediation is becoming increasingly popular today. A tripartite agreement was signed on 23 September 2019 between the Moscow Region Chamber of Advocates, the Moscow Region department of Ministry of Justice of Russian Federation and the Moscow Region Business Ombudsman Vladimir Golovnev. This agreement was a good beginning for the Moscow Region Mediation Center. It is important to note that the Moscow Region is the first one among other Russian Federation regions having such collaboration and cooperation practice in mediation development between various authorities.
The mediation procedures make it possible to deal with the civil, administrative and other public disputes, including the business occurs as well as family and employment relationships. The only exception is either a collective labour dispute or a third party interests being involved.
The mediation is worldwide known as a non-judicial restorative mechanism of criminal law. Another distinctive feature is conflict resolution by consenting parties. All the actions from procedure beginning to its end also as intermediate solutions could be made by parties involved in the conflict and with their complete agreement. Therefore, there is minimal risk in mediation of one party's benefit or any delay in proceedings. Since this procedure has been applied at any stage of dispute settlement, whether it is parties or judge initiative, the court should explain to the parties of their right to be assisted with the mediation if necessary. But it's really formal way in some courts today to spread out all over the country. Meanwhile the judges are quite loyal to the mediation, the
very strict time frames and lack of mediation knowledge is a barrier to competent direction of dispute parties to mediation procedures.
The mediation advantages:
- The judicial review of disputes is long and resource-intensive process for businessmen.
- The likelihood of entrepreneur's rights and interests be protected is far less in a case of any proceeding mistakes.
-The possibility of authorizing the alternative decisions.
As Mariya Svetlova, the head of Moscow Region Mediation Center, said, it is very important the seminars and workshops about various mediation issues and possibilities being held to a broad public and business. Another integral issue is improving knowledge of human rights law and the legal culture of citizens.
