A businessman effectively supported in lawsuit against Customs
The intervention of The Moscow Region Business Ombudsman Vladimir Golovnev in the judicial process with the Moscow Regional Customs resulted in an entrepreneur to obtain a favorable judgment.
A CEO of a limited liability company applied to the Commissioner for the Protection of the Entrepreneur's Rights for support his rights and interests. The business activities aim to providing domestic agricultural producers with modern high - tech devices and import production equipment which do not have the comparable Russian substitutes. For example, water sprinkler machines, that are urgently necessary for federal target program "The expansion of the agricultural land irrigation in Russia 2014-2018" being implemented.
The businessman had an argument with the Moscow Regional Customs about the charges increased in 5% of the value imported water sprinkler machines from 01.01.2015 to 31.12.2016.
Unfortunately, the entrepreneur's application of Business Ombudsman involvement in the case as an unconcerned third party left open-ended by the court. Nevertheless, the consultations, have been held by the Commissioner and his indirect participation in the case helped the entrepreneur to protect his rights. On 12 November this year the Moscow Arbitration Tribunal invalidated the decision of the Moscow Regional Customs and obliged to ensure the complete elimination of the violation.
