Last November a representative of confectionery concern "Shocoladnitsa" ( a net of café & bakeries) appealed to Vladimir Golovnev for protection of his rights and interests.
The statement claimed that in September of 2019 the Domodedovo Investigation unit of the Central Investigation department of the Moscow Region Investigative Committee of Russian Federation initiated the criminal proceedings in connection of company's management tax evasion for 2014-2016 years.
Criminal proceedings had been initiated under part 1of the article 199 of the Criminal Code of Russian Federation (tax evasion in extra-large amount).
According to the complainant, the statute of limitations run out: it has been more than two years since the alleged crimes were supposedly committed, and indeed, the debt was repaid for a total amount over 48 million rubles at the time of the investigation. The investigators were properly informed of the fact.
Having considered the arguments through inter-agency collaboration, Vladimir Golovnev has submitted the case to the Moscow Region Prosecutor’s office for further inspection. As an outcome it found that there was a lack of official payment information. According to the Domodedovo tax office, the payable had been settled only the other day the proceedings taken, on 26 September. It is known any banking transaction requires time, that's why the tax payment information entered the electronic tax office database just on 30 September. An audit we initiated has the effect of closing the case according to the part 1 of the article 28.1 of the Code of Criminal Procedure of Russian Federation. Thus, the budget system of Russian Federation had received the funds required - stated Vladimir Golovnev on the outcome of the audit.
