Trade and Industry Ministry of Russian Federation had drafted a regulation of Government of the Russian Federation " On approval of the Rules of identify the location of the source of extreme danger and demarcation the surrounding area where alcohol's retailing and catering services related is prohibited."

    The idea is to formulate precise rules for objective discussion of regional initiatives of  size of surrounding area demarcated, with participation of all parties concerned, including the representatives of business community. 

The draft document implies that local authorities set up the rules of identification the location of the source of extreme danger where no any alcohol retailing allowed, including surrounding areas. 

    The Trade and Industry Ministry of Russian Federation also proposes the local authorities do specify minimum and maximum size of areas surrounded, to enact legislation related. 

    Therefore, it is expected special Commission will be set up to evaluate any municipal legal initiatives during regulation being drafted. 

    If the borders of surrounding areas, with alcohol retailing prohibited, installed or extended, the OMSU have to send draft act to public authority of the subject of Russian Federation in regulation of trade activities.  These documents also should be send to the Commissioner for the Protection of the Entrepreneur's Rights. 

    Any such decision by the OMSU is to be reasoned with a view of potential loss of trade and catering entities with alcohol retailing. This solution is being justified when alcohol local consumption is reduced. 

    In opinion of Vladimir Golovnev, the Moscow Region Business Ombudsman, this draft regulation would avoid negative effects of unjustified decisions for business.    

  Since the shortcomings of current legislation lead to shops being closed uncontrolled and unfounded, the establishment of special commissions on municipal basis with business representatives at least 50% being included, is very reasonable and transparent during consideration of legislative initiatives. 

The public hearings of draft acts are not possible without special commission's conclusion, including conclusions of regional Commissioners for the Protection of the Entrepreneur's Rights. The business involvement in estimation process of local decisions make an additional possibility for public discussion of business view. "-commented Vladimir Golovnev.  As he said, a practice has shown,  the overstatement of surrounding areas have  no influence on the local alcohol consumption, including juveniles, but only lead to expansion  of illicit market of alcohol production.
