On March 5th, the Moscow Region Business Ombudsman Vladimir Golovnev summarized the 2019's outcomes of Commissioner's Institute work in Moscow Region Duma. This report includes the data of qualitative and quantitative indicators of Ombudsman's Office work, analytical information of business environment in region, enforcement practices and proposals to improve the business legal framework.

    The main part of the report was related to the work with entrepreneur's appeals in 2019 year.

    The Business Ombudsman had marked the main theme of appeals incoming. Up to 2000 (1939) entrepreneurs requested the assistance, in the period of 2013 to 2019 over 8 000 (7941) applications were sent to the Commissioner.

43% of them - applications of territorial representatives of federal executive authority actions, 37%- local authorities, 18%- regional officials, 2%- other authorities, acting beyond Moscow Region.

According to the Business Ombudsman Vladimir Golovnev, the top of five important topics participate: enforcement practices - 27%, administrative obstacles - 19%, reimbursement violations-16%, land and property issues - equal 16%, taxation - 8% (the 5th).

    The themes of major issues have not been changed for 5 years.  In comparison with 2018 year, the most important concern in 2019 year remains business protection from illegal actions of law- enforcement authorities.

    Addressing the dynamic of appeals received, shows small but steadily annual increasing the number of them. A total quantitative difference between 2018 and 2019 years is just 300 applications. "-admitted Vladimir Golovnev. As he noted, the percentage of business complaints of local authorities has declined considerably in 2019 year. Up to 5%, in comparison with 2018 year, reduced the number of complaints of territorial supervision authority, 4%- taxation, 2%- administrative obstacles "- said Vladimir Golovnev. 

    As a result of working with appeals received, by Vladimir Golovnev's words, the rights of 54% of applicants have been fully or partially restored. 

    The rest of appeals have been invalidated or stayed under Commissioner's control. 

    Upon the conclusion of the work last year, the total sum of bills paid under state and municipal contracts was 35,5 million rubles. Over 300 resident's jobs were retained, the properties seized were returned in total amount of 5 million rubles. "- underlined the Business Ombudsman Vladimir Golovnev. At the same time, the public institutions, that were set up in Moscow Region play a growing role in Commissioner's activity for protection the entrepreneur's rights and their legal education. Among these are 35 public receptions, acting in 48 municipalities and 12 public assistants. The Expert and Public Councils operate under the Commissioner's control as well as expert rulemaking and protecting commissions in criminal proceedings of entrepreneurs. Very active collaboration we have with the Moscow Region Mediation Center. 

    A list of our main activities and priorities in 2020 year was formed at the Public Council workshop at the end of 2019 year. It includes: the alternative taxation for business, the sanitary protection zones setting, with proper land using in their territory frames. The issue of legislation implementation while transfer to a new system of applying TKO, also deserves attention. 

    Business should be retained in implementation of mandatory labeling of goods."- concluded the Moscow Region Business Ombudsman Vladimir Golovnev.
