At the end of November 2019, a businessman had signed a contract with a municipal entity on online e-platform to provide a storage system, a table and posters demonstration for general - education school with 850 pupils accommodated, in Podolsk urban district. 

    According to this contract, the goods delivery was implemented at one time during fortnight after the contract signed.

The businessman had kept his side of the contract with goods delivered on December 10th of 2019 year, as confirmed by invoice created on the Moscow Regional Portal of contract management of standard automated procurement system  (PIC EASUS). 

    Thus, having no any quality /quantity claims, the employer has accepted the goods on December 18th and signed the invoice. The total amount of the contract was 2,2 million rubles and provided from the Moscow Region and Podolsk urban district budget. 

    As complainant confirmed, only 226 thousand of rubles were deposited into his account and this is not even a quarter of the contract. 

    "I have not received the contract payment until now, and will demand a fine with further application to an arbitral tribunal if the process is delayed" - reported the entrepreneur in his appeal to the Moscow Region Business Ombudsman Vladimir Golovnev. 

    Having considered the arguments, Vladimir Golovnev has addressed the case to the Moscow Region Office of the Auditor General for further inspection of municipal official inactions. In a case any violations were made, the appropriate measures should be taken, according to the current legislation of Russian Federation. 

    “We control all inspections of financial violations in state and municipal contract performance.

    I had considered 62 appeals related to this concern, with a total amount of 1939 in 2019 year. Unfortunately, the debt to the small and medium business under state or municipal contracts remain relevant during past two years so far.  The number of complaints related to the state and municipal procurement violations increased in 2019 over 2018 year (12% of total appeals). Consequently, a significant improvement has been made in administrative proceedings of Moscow Region Office of the Auditor General on part 1 of the article 7.32.5 of CAVL of Russian Federation. In particular, 21 administrative proceedings were initiated in 2019 year.

    I would like to note, that our main priority is improvement high implementation standards in contract performance rather than just official warnings or charges of administrative responsibility.

    Our interaction with Moscow Region Office of Auditor General is carried out with 100% efficiency” - reported the Commissioner for the Protection of the Entrepreneur's Rights in the Moscow Region Vladimir Golovnev.

    As a result of the joint work of the Moscow Region Business Ombudsman and Moscow Region Office of Auditor General, the Podolsk municipal entity (the goods employer) had paid the debt to the entrepreneur in full, according invoices signed, in total of 2 040 178 rubles.
