The Moscow Region Business Ombudsman Vladimir Golovnev pressed criminal charges on the entrepreneur's application.
The Moscow Region Commissioner for the Protection of the Entrepreneur's Rights considered carefully an entity's CEO appeal of law enforcement inaction.
According to his appeal, on April 15th of 2019 the businessman contracted with transport company to provide forwarding services.
In line with the request from 02.07.19, the transport company was committed to transfer accumulators on the route from loading in Staraya Kupavna of Noginsk urban district of Moscow Region to unloading in village Starozhilovo of Ryazan district.
The carrier vehicle, however, was unloaded in Leninsky district of Moscow Region and the cargo was given to unidentified persons.
At July 2019 a customer applied to the Kupavna department of Interior Ministry Office "Noginskoe" of cargo theft. According to the official response from 17.07.19, the case file was transferred to the Rasvilkovsky department of the Ministry of Internal Affairs of Leninsky district.
As at the end of September 2019, the documents were not received, the businessman appealed to Noginsk Procuracy of authorities of Kupavna department "Noginskoe" inaction. As a result of inspection, the complaint is found justified, but that had not succeeded in solving the problem.
At November 2019 the representatives of the claimant have been told of case file returning in Kupavna department "Noginskoe" of Ministry of Internal Affairs, to the place where the crime had been committed.
"Having considered the arguments of CEO of the company, affected by the goods loss, it is clear that police inaction in preliminary investigation leads to loss of evidences and let the perpetrators to escape the responsibility, that is required by law." - clarified the Moscow Region Business Ombudsman Vladimir Golovnev.
In addition, a dispute between shipment's customer and a transport company about goods loss was resolved in Arbital Tribunal of Ryazan district. According to its resolution from 10.12.19, the transport company has been charged in favor of complaint in total amount of 1 million 116 thousand of rubles. No criminal case, however, was opened.
