The 247 Federal Law from 31.07.20 "On mandatory requirements in Russian Federation" (on mandatory business requirements), define the principle of establishing and an assessment of the implementation. The law specify the general conditions for mandatory requirements legal implementation, taking into account risk factors and to minimize the negative impact.

The 248 Federal Law "On the State control ( supervision) and municipal control in Russian Federation" from 31.07.20 extends the list of supervision activities as well as confirms the primacy of preventive measures to supervision, applies risk - based approach.

    The law of mandatory requirements includes the entry into force from March 1st or September 1st but not before 90 days after being published.

    This rule does not apply to acts that prevent terrorist attack and elimination of consequences in the case of defence threat and the state security risk at the emergency situation. The extended period is six years with further extension for the same period, according to result evaluation.

    This rule does not apply to acts, related to the state - private partnership acts.

The law of the state control provides the possibility to avoid scheduled inspections.

The work of supervision authorities estimates according to the number of violations as it was before. The punishments remain lawful along with violation prevention in priority, the work of inspectors will be assessed under demage prevented.

    The law of state control includes new supervision activities, for example an inspection visit that is much shorter than official check. Some control activities will be held under digital format. By this way, the law provides basic principles of risk - based approach - the higher potential threat, the more attention should be from supervision authorities and vice-versa.

    Only once in two years the high risk objects may be fall under routine control. In the case of voluntary insurance, an entrepreneur falls into the minimum risk category that is dismissed from any inspections.

    "The implementation of such laws shows the review of contradictory legislation in Russian Federation, that business should comply with. This is so-called "a guillotine regulatory",  in spite of its terrible name let the businessmen avoid the absurd claims and time wasting due to numerous inspections.

    Even the best intention could not justify unnecessary pressure to business. The risk-based approach, based on new legislation, had successfully pass the test in Moscow Region and other subjects of Russian Federation, having revealed its high efficiency".- stated the Moscow Region Business Ombudsman Vladimir Golovnev.

    The 247 Federal Law from 31.07.20 "On mandatory requirements in Russian Federation" will enter into force on November 1st of 2020. It will be fully operational when the law of control and supervision will be implemented - by July the 1st of 2021 year,with exception of some parts with other period of implementation. Thus, the part 1 of article 3 of current Federal Law enters into force on February 1st of 2021, the parts 2 and 3 of article 10 enter into force on March 1st of 2021.

    The Federal Ministry of Economic Development of Russian Federation along with departments related and business community intends to prepare an additional legislation to provide efficient work of laws adopted.

    By July 1st of 2021 a unified register of federal, regional and municipal control will be set up.

    A basic work for supervision reform in Russian Federation is expected to be completed the end of 2022 year.
