Nearly 450 thousand rubles were paid to an entrepreneur by Podolsk municipal entity for the executed contract.
The result of the consideration by the Moscow Region Commissioner for the Protection of the Entrepreneur's Rights of the appeal of an entrepreneur was the full payment of the debt for the services made under the municipal contract.
The applicant pointed out the inaction of the Podolsk municipal entity that relates with non-payment of debt under the executed contract. The amount owed was almost 450 thousand rubles.
At the end of May of 2020, an agreement was concluded between the Podolsk municipal entity and a LLC company for the supply of summer special clothing and footwear for the needs of the municipal unitary enterprise.
“On August 3, the contract executing company delivered the necessary goods for more than 325 thousand rubles, which was confirmed by a transfer document (UPD) signed on both sides. In addition, on August 21st and September 7th of 2020, the contract holder, in accordance with the agreements concluded, carried out two more deliveries of goods, for a total amount of 449 thousand 226 rubles, which was also confirmed by the UPD. "Thus, the contractual obligations were fulfilled by the contractor in full, of proper quality and on time, without violating the terms of the contract”, said Vladimir Golovnev, the Moscow Region Business Ombudsman.
At the time of application being addressed to the regional Ombudsman (at the end of January 2021), only the first delivery was paid to the settlement account of the LLC which amounted to only 42% of the total contract value.
“At the same time, the municipal entity did not react in any way to the claim sent by the contractor back in October last year, and kept silent,” the Business Ombudsman added a clarifying detail.
According to Vladimir Golovnev, the situation was solved at the municipal level along with the authorities of Podolsk urban district.
“I have to note the prompt response of the local administration to our letter describing the problem. Less than a week after our request, the debt was fully repaid, which was confirmed by a written notification and a copy of the payment order”, said Vladimir Golovnev, the Moscow Region Business Ombudsman, following the results of his work with this appeal.
