The criminal liability is introduced for fake codes of mandatory goods marking.
These amendments are made to Article 171.1 of the Criminal Code of the Russian Federation, which regulates the production, acquisition, storage, transportation, sales of non-marked products.
The relevant draft was developed by the Ministry of Industry and Commerce of Russia to combat the implementation of dangerous or low-quality goods, as well as with non-payment of taxes and customs payments. The government commission on legislative drafting activities has already supported the draft law of the Ministry of Industry and Commerce of Russian Federation. In fact, fake marking is equal to its absence, according to the draft.
Until April 17th this document is on independent anti-corruption examination. There is also a public discussion of the text of the draft law scheduled.
Thus, for using fake identification for marking goods and drugs, it is proposed a fine of 100 to 500 thousand of rubles, or forced work for a period of 3 to 5 years, or imprisonment for the same period. For the use of falsification of identification for tobacco products, business will be fined from 300 to 500 rubles. The most severe punishment on this article implies imprisonment - up to 8 years with a fine of up to 1 million rubles.
"The list of goods subject to labeling is gradually expanding. For example, from June 1st of 2021, the marking will become mandatory for ice cream and cheese. On April 1st of 2021, an experiment on labeling of beer, beverages manufactured on the basis of beer, and certain types of low alcohol beverages will begin. The experiment on labeling of beer will last until August 31st of 2021, after which voluntary participation in the experiment will replace mandatory marking. It is assumed that by 2024, the marking will spread to all consumer products, and the goods tracking system will become united for Russia and Eurasian Economic Union countries (EAEU)"- said the Moscow Region Business Ombudsman Vladimir Golovnev.
