A plant producing special fabrics in Pavlovsky Posad urban district was under the threat of closure.
Located on the territory of the enterprise, the object of civil defense has long been overhaul. Conducting construction and installation work of this scale by their own forces inevitably led to bankruptcy and closure of the enterprise. Participation of the Moscow Region Business Ombudsman in resolving this difficult situation determined the outcome of the case - the court took into account the arguments of the textile plant.
A closed joint-stock company requested the Moscow Region Business Ombudsman to take part in civil cases as a third party.
It follows from the appeal that the applicant's property, which is the largest manufacturer of sieve fabrics in Russia and the CIS countries and works in the territory of the Moscow Region since 1860, is a production building with a basement, which should be used as a protective construction of civil defense.
Over time, the protective properties of this facility were lost, сurrently, the basement is placed in unsatisfactory condition and is not suitable for use.
Because for repair and complete recovery, taking into account the requirements for such a placement significant financial advances are needed, the Pavlovsky Posad Prosecutor's Office appealed to the city court with a claim for recognition by the Russian Federation of ownership of this room and the restoration fee forces by the territorial administration of the Federal Property Management Agency for the Moscow Region.
In order to protect the rights and legitimate interests of the applicant, the Moscow Region Business Ombudsman decided to enter into the case as a third party,
Without declared independent claims. It satisfied this petition and recognized the authorized to protect the rights of entrepreneurs in the Moscow region a third party on this civilian.
In turn, a compidant in the case, which is the territorial management of the Federal Property Management Agency in the Moscow region actually demanded to be entrusted on the applicant burden in the form of recovery and the further content of the specified basement.
"Such a value would bring to partial or complete cessation of the plant's activities. An enterprise specializing in the production of church, technical and sieve fabrics cannot be carried out by construction and installation work, the budget of which can be assessed in tens of millions of rubles. Among other things, the team of qualified professionals could lose their job and remain without livelihood. In addition, this enterprise retains the age-old traditions of textile production, which originated more than a century ago in Pavlovsky Posad, "said the Moscow Region Business Ombudsman Vladimir Golovnev.
On April 13th of 2021, the claim of the Pavlovsky Posad city prosecutor's office was satisfied in full, the threat of closing the plant was eliminated.
