Conducting a search in the premises, whose owner is an entrepreneur from Orekhovo-Zuyevo urban district, paralyzed the activities of not only the applicant's organization, but also other individual entrepreneurs acting on the leased areas. 

On the appeal of the Moscow Region authorized by the Prosecutor's Office, compliance with the observance of legality during investigative actions was carried out.  As a result of the inspection, violations of criminal procedure legislation were revealed.  A requirement of Orehovo-Zuyevo prosecutor's office, introduced in the city investigative department of the Main Investigation Committee of the Russian Federation in the Moscow Region, was considered and satisfied, seized objects and documents were returned to the owners.

A group of entrepreneurs from Orekhovo-Zuyevo applied to the Moscow Region Business Ombudsman to protect the rights of regional entrepreneurs against the actions of the police.

In early 2021 in the industrial premises LLC located on the territory of Orekhovo-Zuevo, during the search by employees of the Ministry of Internal Affairs of Russia in  Orekhovo-Zuyevo were seized 25 computers, printing, external information storage devices belonging to entrepreneurs leaseing areas in this building.

According to the applicant, the documents that confirmed the search have not been presented, the protocol copy was not presented to entrepreneurs. 

It was established that the police acted as part of the commission of the investigative department for the city of Orekhovo-Zuyevo of the Chief Investigation Department of the Investigative Committee of the Russian Federation in the Moscow Region in the investigation of a criminal case, excited

For part 3 Art.  159 of the Criminal Code in relation to the entrepreneur.

These police actions of the police paralyzed  the activities of the LLC and caused losses to the applicant and several other individual tenant entrepreneurs.

In appealing to the protection of the rights of entrepreneurs in the Moscow Region, the regional prosecutor's office carried out a check, with the results of identification violations of criminal procedural legislation, which were expressed in the fact that the items seized during the search. 

And the documents were not inspected, and their involvement in the criminal case was not verified, in the investigative department for the city of Orekhovo-Zuyevo Investigating Committee of the Russian Federation in the Moscow Region made the requirement of the Orekhovo-Zuyevo  prosecutor's office.  The requirement was considered and satisfied, and the seized computers and flash drives are returned to their owners. For the adoption of other measures of the prosecutor's response, it is not established.
