The Moscow Region Business Ombudsman Vladimir Golovnev helped the entrepreneur in resolving the issue of payment for the executed contract.
Consideration of the appeal of an entrepreneur from St. Petersburg about non-payment for the delivered goods was terminated by the Commissioner for the Protection of the Rights of an Entrepreneur in the Moscow Region in connection with payment for the executed contract.
Thus, it was possible to resolve the conflict situation and avoid lengthy legal proceedings between the entrepreneur (limited liability company) and the federal budgetary institution. This was announced by the business ombudsman of the Moscow region Vladimir Golovnev.
According to the entrepreneur (the CEO of LLC ), whose rights were violated in the Moscow Region , as part of the procurement posted on the EIS website in the field of procurement, between the company and the rehabilitation and training center of the federal budgetary institution, which is located in Odintsovo , at the end of 2020, a contract was signed for the supply of UV bactericidal recirculators in the amount of just over 1.6 million rubles. The delivery of this equipment was carried out in full, the goods met the established standards.
After that, within the framework of the conditions fixed in the contract, the customer had to pay for the delivered goods. However, this did not happen even after the deadline for making payments - until the end of January 2021.
“On this occasion, along with my representatives we communicated with the leadership of the FBU. However, we have not been provided with information on when the payment will be made. We ask you to understand the current situation and help in resolving the issue of payment", the entrepreneur said in a statement.
"Guided by clause 1 of part 3 of article 10 of the Federal Law of 07.05.2013 No. 78-FZ" On Commissioners for the Protection of the Rights of Entrepreneurs in the Russian Federation ", it was decided to apply directly to the management of the federal budgetary institution to conduct an audit on the fact of inaction of officials of the institution subordinate to the FBU ", - explained the regional business ombudsman.
" The reaction of the FBU leadership was not long in coming. Soon after receiving our letter, the applicant informed us about the full payment of the contract and thanked us for assistance in solving this problem, ”Vladimir Golovnev said.
According to the Moscow Region Business Ombudsman , this year, in the category of "violations in the field of state and municipal procurement", 14 applications on this topic were considered, which amounted to 11.5% of the total number (765) of written appeals of entrepreneurs considered in the current year.
“For the same period last 2020, the percentage of requests on this topic was 11.7%. In total, last year we received 49 requests from entrepreneurs on this topic", summed up the Ombudsman for the Protection of the Rights of Entrepreneurs in the Moscow Region Vladimir Golovnev.
