At the initiative of the Federal Business Ombudsman, a series of webinars is being held these days with the heads of the control and supervisory bodies, dedicated to clarifying the norms of the Federal Law of July 31st of2020 No. 248-FZ "On State Control (Supervision) and Municipal Control in the Russian Federation" 

Today's meeting with regional commissioners and representatives of business associations was devoted to the topic of inspections by Rostrud.

According to the department, state control and supervision will be carried out on the basis of harm risk management, which determines the choice of preventive and control and supervisory measures, their content (including the scope of mandatory requirements being checked), intensity and results.

From July the 1st of 2021, six categories of risk of harm (damage) will also remain. Along with the measures used today, the new law provides for additional control methods: 

- on-site examination (visual inspection at the location or operation of an organization, citizen, object of control by inspecting publicly available production facilities without notifying the controlled person);

- monitoring procurement, that is, the purchase of goods or the order of work / services to be sent for testing, examination, research to verify compliance with safety and (or) quality requirements); 

- selective control - selection of product samples at the place of storage and implementation in order to confirm their compliance with the mandatory requirements for safety and (or) quality); 

- an inspection visit, which implies a visit by an official of the controlling body at the location of the controlled person, during which an inspection, questioning, obtaining explanations is carried out, instrumental examination and retrieval of documents).

At the same time, as was  explained in Rostrud, inspections that were not completed on July 1st of 2021, will be carried out according to the old rules. 

“Of course, in the process of applying the new law in practice, an important role is assigned to the institution of Ombudsmen. The law`developers are ready to consider proposals and, if necessary, supplement the current version, - said Vladimir Golovnev, the Moscow Region Business Ombudsman. “In addition,  an agreement was reached with Rostrud on holding joint seminars for entrepreneurs in the regions, contributing to the prevention of business offenses.”
