The issues of implementing the Federal Law on state control were discussed at a round table in Yegoryevsk city district of Moscow Region.
On September 2nd, the Commissioner for the Protection of the Rights of Entrepreneurs in the Moscow Region Vladimir Golovnev held a round table with the business community of the Yegoryevsk city district.
The discussion was attended by the chairman of the Council of Deputies of the city district Mikhail Lavrov, the head of the Mediation Center of the Moscow Region Maria Svetlova and municipal entrepreneurs.
Speaking about how business will be checked after the new Federal Law No. 248 on state control comes into force, the Commissioner stressed that the Law was changed just in search of an optimal balance between public and private interests. So that the number of fines and bans ceases to be a criterion for the successful work of dozens of control and supervisory authorities. "The essence is to shift the focus from conducting inspections to preventing violations”, Golovnev noted.
– In addition to face-to-face communication, the new law provides for online interaction of inspectors with entrepreneurs. For example, businessmen will be able to learn about upcoming events, actions and decisions of state bodies through the Unified Portal of Public Services. The law establishes the priority of preventive measures in relation to control and supervisory ones. There are measures to stimulate conscientiousness, self-examination, preventive visits. An independent assessment of entrepreneurs ' compliance with mandatory requirements is provided. This assessment will be carried out by independent accredited organizations. If such an organization confirms that the entrepreneur complies with the mandatory requirements, it will issue an appropriate conclusion. As a general rule, planned control and supervisory measures should not be carried out while it is in effect". Vladimir Golovnev noted that the law on state control continues to change, there is an active discussion of by-laws. In this work, a special role is assigned to the institute of commissioners for the protection of the rights of entrepreneurs. "We are closely monitoring how the new law on state control is applied in practice, we are trying to convey its main provisions to as many entrepreneurs as possible by all possible means.
On behalf of the Federal Business Ombudsman and the Prosecutor General's Office, we send monthly data from our monitoring on the implementation of the law and emerging issues for timely correction of the document and ensuring the stable work of supervisors and businesses", the Commissioner stressed.
Summing up the meeting, Vladimir Golovnev announced the results of the work for 8 months of this year. More than 1600 requests were received. The topic of land and property relations has become more acute, complaints about the actions of law enforcement agencies, violations in the field of state and municipal procurement are still in the leaders. It is possible to restore fully or partially the rights of entrepreneurs in 60-70% of cases.
