Having suggested the procedure, the Business Ombudsman helped the entrepreneur to receive payment for services.
At the end of August of this year, an individual entrepreneur, while providing services for the transportation of goods by road, was hired by a transport company from the town of Istra to transport ventilation equipment worth 12 million rubles from the town of Ramenskoye to the town Mirny, Arkhangelsk region.
After completing the transportation and unloading the equipment, the entrepreneur sent the documents to the customer by registered mail, hoping to receive payment within the terms under the contract - 7-10 days. But he was forced to wait almost a month for the payments due.
From hopelessness, the entrepreneur sent a complaint to the Commissioner for the Protection of the Rights of Entrepreneurs in the Moscow Region.
According to the Law of the Moscow Region dated 13.01.2014 No. 1/2014-OZ "About the Commissioner for protection of entrepreneurs ' rights in the Moscow Region and amending the Law of Moscow Region "On the salaries of persons holding public positions of the Moscow Region and positions the state civil service of the Moscow Region", the Commissioner is entitled to accept the limits of its competence measures for the settlement of disputes between entrepreneurs, on the one hand, and public authorities, local self-government bodies, organizations and officials whose actions are being appealed, on the other hand.
This case was not within the authority of the Commissioner. However, the explained procedure in the circumstances helped the entrepreneur to get out of a difficult situation. The applicant was asked to send a pre-trial claim to the Company that hired the businessman, as well as recommendations for its preparation. As a result, within a few days, funds for previously rendered services received to the entrepreneur's account.
