Administrative burden on Moscow region business: numbers on paper are worse than the real state of affairs.
This year's final meeting of the Expert Council under the Commissioner for the Protection of the Rights of Entrepreneurs in the Moscow Region was held today in the Regional Government.
The results of the activities of the body of state protection of the rights and legitimate interests of regional business with the business community and executive authorities of the Moscow Region were summed up.
The meeting was attended by heads and representatives of relevant ministries and departments, the Office of the Commissioner under the President of the Russian Federation, the Main Department of the Ministry of Emergency Situations in the Moscow Region, the Rosreestr Department, the Rospotrebnadzor Department, the Main Labor Inspectorate of the Moscow Region, the Moscow Regional Duma, the regional prosecutor's office, representatives of human rights organizations and public associations.
The issues on the agenda were discussed in full-time and correspondence form. In particular, most of the discussion was devoted to the results of the Index "Administrative Pressure - 2021", in which the Moscow Region rose by 22 positions, taking 37th place.
At the same time, according to the results of the National rating of the state of the investment climate in the constituent entities of the Russian Federation, the Moscow Region took 7th place in 2019 and 2020 years.
The meeting participants discussed what is the reason for these circumstances, what is the likelihood of improvement in the performance of departments, whose indicators are taken into account in the Index, when working with data for 2021, to what extent the current situation in the Moscow Region corresponds to the conclusions indicated in the study.
“The total number of inspections at the federal, regional and municipal levels across the country has decreased by 60%. A similar situation is observed in the Moscow Region. Only 4% of the total number of appeals that come to me for consideration are complaints related to control and supervisory activities- commented Vladimir Golovnev. It is worth recalling that in 2022 the moratorium on scheduled inspections of businesses will be extended, which will also noticeably affect the statistics data."
The Business Ombudsman also noted that close interaction with all control and supervisory departments of the Moscow Region allows you to quickly resolve all emerging issues and relieve some of the burden on business. In accordance with the new 248-FL, the results of the audit can be appealed in pre-trial format with the involvement of the Ombudsman.
In the event that the violation was committed for the first time or its severity is not great, then the decision on the results of the inspection, followed by the imposition of an administrative fine, may be canceled.
During the meeting, the plan for the Annual Report of the Commissioner for 2021 year was also approved and the issue of developing the institution of out-of-court settlement of disputes arising from public legal relations in the Moscow Region was considered.
