The Moscow Region Commissioner helped the entrepreneur to resolve the conflict with the resource-supplying organization and reduce the cost of connecting to the water supply networks by a third.
In a pre-trial order, it was possible to resolve the conflict that arose between a Moscow Region entrepreneur, the municipal administration and a resource-supplying organization.
The reason why the commercial company turned to the Regional Business Ombudsman Vladimir Golovnev for the protection of its rights and legitimate interests was the systematic actions of the city administration, complicating the company's activities.
For example, the local self-government body sent materials to the internal affairs bodies, which, according to the administration, indicated that the entrepreneur had committed a criminally punishable act. These materials served as the basis for repeated verification actions against the businessman.
And in August last year, the municipal administration, in violation of the requirements of the legislation of the Russian Federation, issued an order for emergency work, allegedly in order to prepare water supply networks for the heating season. The resource-supplying organization, the only participant of which is the administration, is the Vodokanal on the basis of the specified warrant, the excavation of the paved area was carried out, as a result of which no communications were found. The specified opening significantly complicated the entrance to the enterprise of the entrepreneur who asked for help from the Business Ombudsman. Landscaping was restored only a month later as a result of the intervention of the Prosecutor's Office of the Moscow Region.
But the businessman's torment did not end there. The entrepreneur appealed to the Vodokanal with a request to carry out technological connection to the cold water supply and sewerage networks. The technical conditions for connection issued by the resource-supplying organization contained excessive requirements and clearly indicated the intention of the Vodokanal to unlawfully carry out the development of urban networks at the expense of the enterprise. As a result of the actions of the Vodokanal the cost of connection turned out to be significantly overstated. The businessman was forced to provide water supply by bringing water and removing wastewater to the facility by motor transport.
Finding himself in a desperate situation, the head of the enterprise turned to the Commissioner for the Protection of the Rights of Entrepreneurs in the Moscow Region. At a meeting initiated by Vladimir Golovnev, with the participation of all parties of the conflict, as well as the Ministry of Ecology and Nature Management of the Moscow Region and the Regional Prosecutor's Office, solutions were developed that allowed to resolve the current situation. The resource-supplying organization has issued the entrepreneur new technical conditions for connection to the water supply networks, the cost of such connection has been reduced by a third relative to the original one. For the implementation of water supply facilities to the businessman before the Vodokanal performs work on technological connection, temporary connection points to the water supply networks are provided.
