After consideration of the appeal by the Moscow Business Ombudsman, the initiation of a criminal case was refused.
In March, employees of the investigative department of Odintsovo city district (the Main Investigative Department of the Investigative Committee of the Russian Federation for the Moscow Region) came to the office of the sculpture workshop to conduct an inspection.
The reason for the appearance of law enforcement agencies in the company was the statement of a former employee of the organization about non-payment of wages in 2017 year.
During the verification measures, computer equipment and financial documentation of the organization were withdrawn.
For the protection of their rights, the workshop management turned to the Commissioner for the Protection of the Rights of Entrepreneurs in the Moscow Region, Vladimir Golovnev.
When considering the appeal by the Moscow Business Ombudsman, it was found that the seizure of electronic media was carried out in violation of the requirements of Article 164.1 of the Code of Criminal Procedure of the Russian Federation. In addition, in violation of Part 3 of Article 177 of the Criminal Procedure Code of the Russian Federation, property and documentation, having no connection with the procedural check, were seized from the organization.
As a result of the Commissioner's appeal, the Prosecutor's office of the Moscow Region conducted an inspection, and according to its results, in connection with the revealed violations of the criminal procedure legislation, the head of the investigative department in the Odintsovo city district received a demand from the prosecutor's office.
Less than a month after the seizure of the property, all the equipment and documentation of the company was returned, the procedural check against the workshop was completed, and the criminal proceedings were refused.
