Progress has been made in the protracted litigation between the head of the peasant farm and the Ramenskoye administration. 

For more than six months, the Commissioner for the Protection of the Rights of Entrepreneurs in the Moscow Region, Vladimir Golovnev, and his representatives defended the interests of the entrepreneur in court.

The story began back in August 2021. The administration of the Ramenskoye city district has established a public easement with respect to a part of the land owned by a businessman and used for agricultural production, including goat's milk cheese, for the purpose of passage or passage to land plots provided for individual housing construction. As a result, the use of land for its intended purpose could become virtually impossible.

For the protection of his rights and legitimate interests, the entrepreneur appealed to the Moscow Business Ombudsman.

As part of the work on the appeal, Vladimir Golovnev initiated a working meeting with the participation of representatives of the Ministry of Agriculture and Food of the Moscow Region, the administration of the Ramenskoye City District and the head of the peasant farm, at which the municipal authorities were invited to consider, in a pre-trial manner, the cancellation of the decree on the establishment of a public easement. However, no consensus was reached on this issue, and the entrepreneur, with the support of the Commissioner, appealed to the court.

"We have prepared a response to the statement of claim of the head of the farm, in which they indicated that the imposition of a public easement does not meet the principles established by paragraph 8 of Article 23 of the Land Code of the Russian Federation, on the presence of linear structures on this part of the land plot on which a public easement is imposed – a gas pipeline, two gas control points and a 10 KW power line," – noted Vladimir Golovnev.

"The court considered our arguments, the arguments of the lawyer, the Ministry of Agriculture and Food of the Moscow Region and Mosoblgaz justified and invalidated the decision of the administration of the Ramenskoye city district. The matter remained small: municipal officials should prepare the relevant documents for the cancellation of this resolution. In the current economic conditions, we must take care of every entrepreneur, and not put additional obstacles in their way. Ensuring import substitution and food security is a priority of the state and the head of the Moscow Region. Therefore, such situations should not arise on the territory of the Moscow Region," Vladimir Golovnev summed up.
