Entrepreneurs from the Moscow Region can consider economic disputes in arbitration.
Defending your interests in court is long and costly. Any entrepreneur knows about this. But there is also an alternative option for dispute resolution – arbitration. It saves money, time, and most importantly guarantees complete confidentiality.
According to the Federal Law "On Arbitration (Arbitration Proceedings) in the Russian Federation", from 01.11.2017, activities in this area are possible only on the basis of a special right granted by a state authority. Out of several thousand previously operating arbitration centers, only three non-profit organizations were able to ensure compliance with the new legislative requirements. One of them is the Arbitration Center at the Russian Union of Industrialists and Entrepreneurs, which has been operating since 2016.
"Time is of key importance for any entrepreneur. The sooner one issue is resolved, the faster the businessman will be able to switch to solving the next problem. Today in Russia, economic disputes are considered mainly in the courts. But state courts are overloaded with cases. Because of this, the deadlines established by law for the consideration of civil cases are violated, the entrepreneur files a claim to the arbitration court, then to a higher court, appeal, cassation. Instead of developing, a business can stand in one place for years," said Vladimir Golovnev, the Moscow Business Ombudsman. - In this regard, in most economically developed countries, commercial disputes are considered precisely within the framework of arbitration. For example, in China and the USA, the share of such cases reaches 70%."
The Moscow Region is now also joining the global practice. The Commissioner for the Protection of the Rights of entrepreneurs in the Moscow Region, Vladimir Golovnev, and the Chairman of the Presidium of the Board of Arbitrators of the Arbitration Center at the RSPP, Alexey Galoganov, signed an agreement.
The parties agreed to create favorable conditions for the development of alternative ways of resolving economic disputes, including arbitration and international commercial arbitration.
"In this way we will solve the main task: we will unload the courts of general jurisdiction of the Moscow region and speed up the processes of consideration of cases. But what is no less important – we will solve the issues professionally," commented Galoganov.
The signatories agreed to sum up the first results of their joint activities at the end of 2022.
