The right to purchase municipal property was realized after the intervention of the Moscow Business Ombudsman.
The litigation ended in favor of the business from the Domodedovo city district.
The municipal administration for two years prevented the organization from exercising the pre-emptive right to purchase leased municipal real estate until the Commissioner for the Protection of the Rights of an Entrepreneur of the Moscow Region, Vladimir Golovnev, intervened in the case.
Back in 2008, a non-residential premises lease agreement was signed between the bookstore and the Property management Committee of the Domodedovo City District Administration. In 2020, the management of the organization decided to buy the square meters leased from the city. Having collected the necessary documents, the corresponding application was submitted to the administration in April 2020. The municipal authorities had to evaluate the privatized property, make a decision on the conditions of privatization and send the applicant a draft purchase and sale agreement by July of the same year. But this was not done. The administration refused to satisfy the company's application. The entrepreneur appealed to the court.
Having lost a whole year, but having won the case in the Arbitration Court, the entrepreneur's claims were never satisfied. The administration of the Domodedovo City District in every possible way evaded the execution of the court decision, thereby violating the rights and legitimate interests of the company and prevent to run business.
The store's management was able to buy out the rented premises only in May 2021 with the assistance of the Moscow Business Ombudsman. But the proceedings with the local authorities did not end there either. During the litigation, the company over paid payments under the lease agreement for non-residential premises, which the administration refused to reimburse to the legal entity.
On this fact, the Commissioner for the Protection of the Rights of Entrepreneurs, Vladimir Golovnev, appealed to the regional prosecutor's office. An inspection was carried out and, in connection with the revealed violations of legislation in the field of entrepreneurship, the head of the Domodedovo City district submitted a submission to the Domodedovo City Prosecutor's Office. But even this did not prompt the local authorities to fulfill their obligations to business. The company's management, with the support of the Business Ombudsman, was again forced to go to court.
In January 2022, the Arbitration Court of the Moscow Region decided to recover losses totaling more than 1 million rubles from the administration of the Domodedovo City District in favor of the organization.
After almost another six months, the funds were finally transferred to the company's current account.
"In conditions of pressure on the Russian economy, many entrepreneurs continue their business "not thanks, but in spite of". They do not ask the state for additional money, they only want to get what they are legally entitled to. The "New Economy of the Moscow Region", announced at the beginning of the year by the Governor of the Moscow Region Vorobyov A.Y., is also aimed at preserving jobs and helping businesses adapt to new conditions. And sabotage on the ground is unacceptable. Municipal authorities should by all means promote, not hinder business, be client–centric in relation to both residents and entrepreneurs who provide employment for the population and filling budgets at all levels," Vladimir Golovnev commented on the situation.
