The Commissioner for the Protection of the Rights of Entrepreneurs of the Moscow Region was approached by a company engaged in entrepreneurial activity in the Balashikha city district.
The applicant's representative complained about repeated refusals to issue a permit for the reconstruction of the industrial building. As part of the reconstruction, it is planned to construct an overlap separating a part of the building in the horizontal plane in order to organize an everyday room for employees.
From the documents justifying the refusal to issue a permit for reconstruction, as well as the applicant's explanations, the Commissioner concluded that there were signs that the regional Ministry of Housing Policy had established excessive requirements for the package of documents submitted by the applicant as part of the reconstruction project.
For a comprehensive review of the current situation, the Business Ombudsman decided to hold a meeting of the working group of the Expert Council under the Commissioner for the Protection of the Rights of Entrepreneurs of the Moscow Region. Representatives of the applicant and the Ministry of Housing Policy were invited to participate in the meeting.
During the discussion, the Ministry stated the position that there was no intention to establish excessive requirements for the reconstruction project submitted by the applicant. The representative of the Ministry explained that in order to exclude disagreements, it is necessary to explicitly indicate in the draft the grounds for determining the scope of architectural and structural solutions by the customer.
Following the results of the meeting, the Commissioner and the Construction Assistance Center of the Moscow Region (CSS MO) were instructed to accompany the applicant until he received a permit for reconstruction.
In order to implement this decision, a meeting was held with the participation of a representative of the Commissioner at the Ministry representatives, who explained to the applicant exactly what information needed to be included in the text part of the project. There are no other comments to the project documentation. The deadlines for submitting an application for a permit for reconstruction have been determined.
Issues related to the applicant's obtaining a permit for reconstruction remain under the control of the Commissioner.
