Bankruptcy procedures were discussed at a round table in the Moscow City Duma.

The Commissioner for the Protection of the Rights of Entrepreneurs in the Moscow Region along with the Moscow Region Office of the Federal Tax Service and the Committee on Budget, Financial, Economic Policy, Investment and Entrepreneurship of the Moscow Regional Duma, held a round table on the topic "Modern practice of applying conciliation procedures in the field of bankruptcy.

The subject of the discussion held in the Moscow City Duma of the round table was the abolition of the moratorium on bankruptcy and its possible consequences for business.

Representatives of the Federal Tax Service of Russia in the Moscow Region told about the procedure and stages of bankruptcy, including the methods of pre-trial settlement. Particular attention was paid to the mechanism of concluding a settlement agreement as one of the most important tools for getting out of the pre-bankruptcy state, allowing the entrepreneur to pay the debt in installments and thus prevent the closure of the organization.

Separately, it was emphasized that only for 2021 total revenues (to the budget) from the settlement agreements amounted to 267 million rubles.

To improve the procedure, the bodies of the Federal Tax Service have created a pilot project for debt restructuring, with the help of which the company, which is in the stage of bankruptcy, is personally "led" by special consultants.

A special tool is also under development-an algorithm that allows you to quickly check the reliability of the guarantor providing bank guarantees under a settlement agreement.

During the event, it was told about law enforcement practice and statistics on incoming appeals related to bankruptcy.

-- In today's difficult economic conditions, it is important to understand how the bankruptcy procedure can affect business. It is necessary to warn the entrepreneur, tell him what needs to be done to avoid this. In our practice, appeals related to this topic are rare. However, there are questions that are harbingers of bankruptcy, including complaints against government agencies, whose actions and decisions may lead to it. In cases involving, for example, additional taxes, we work closely with the regional tax service and jointly find ways out of this situation. In addition, we systematically conduct legal education of the business community, organizing thematic webinars and seminars along with the Moscow Region Chamber of Advocates, and also take part in online conferences of the Tax Service," commented Vladimir Golovnev, the Commissioner for the Protection of the Rights of Entrepreneurs in the Moscow Region.
