After the intervention of the Commissioner for the Protection of the Rights of Entrepreneurs in the Moscow Region Vladimir Golovnev, the decision to refuse to initiate a criminal case on the application of a Khimki businessman was canceled.
An entrepreneur from the Khimki city district sent documents to the court through the Russian Post. According to the applicant, the employees of the local post office sent the letter "retroactively", because of which his company lost the court. The businessman appealed to law enforcement agencies, but the police refused to initiate criminal proceedings under Article 327 of the Criminal Code of the Russian Federation (Forgery, manufacture or circulation of forged documents, state awards, stamps, seals or letterheads).
For the protection of his rights and legitimate interests, the entrepreneur turned to the Moscow Business Ombudsman. Having studied the applicant's arguments, Vladimir Golovnev connected the Prosecutor's office of the Moscow Region to the consideration of this issue, and after checking, recognized the refusal to initiate a criminal case as unfounded and canceled it.
According to the facts of the revealed violations of the criminal procedure legislation, the police submitted an elimination of bringing the guilty officials to disciplinary respons. The issue of protecting entrepreneurs from illegal actions or inaction of the police continues to be one of the priorities. By the end of 2022, more than 16% of appeals were related to the activities of law enforcement agencies. Interaction with the prosecutor's office plays a decisive role in the positive consideration of such appeals, as happened in this case. Until a point is put in the question, the entrepreneur's statement remains under my control," concluded Vladimir Golovnev.
