The Commissioner for the Protection of the Rights of Entrepreneurs in the Moscow Region, was approached by a businessman from the Moscow Region.
Having won the tender and fulfilled the state contract for the supply of component materials for one of the state organizations in the Republic of Dagestan, the entrepreneur could not receive the money due to him.
In August 2021, the entrepreneur won a tender for the supply of materials to a state organization in the Republic of Dagestan. In order to manufacture goods and fulfill the technical task under the state contract, the businessman took loans for the purchase of raw materials. The entrepreneur delivered the goods to the customer in a timely manner and in full.
The contract contained a provision on mandatory treasury support of the Federal Treasury Department in St. Petersburg. The supplier sent an Expense Declaration to the Depatment, formed on the basis of data from separate accounting of the results of financial and economic activities, which was reviewed with a number of violations identified. In this connection, the funds under the executed contract were not credited to the entrepreneur's account.
The applicant appealed to the Commissioner for the Protection of the Rights of Entrepreneurs in the Moscow Region. Having considered the applicant's arguments, Vladimir Golovnev appealed to the Federal Treasury Department in St. Petersburg with a request to conduct a second check for compliance with the information provided by the entrepreneur.
The Department agreed with the arguments of the Business Ombudsman Vladimir Golovnev and the entrepreneur was transferred funds in the amount of 2.3 million rubles spent on the purchase of raw materials.
