Vladimir Golovnev stressed the importance of pre-trial settlement of disputes.
Earlier, the Commissioner for the Protection of the Rights of Entrepreneurs Vladimir Golovnev summing up the results of work for 2022, spoke about participation in lawsuits. Separately, he noted the activities of the state body for the out-of-court settlement of disputes arising from public legal relations that have arisen between business and authorities.
"Since judicial proceedings are long, expensive and energy–consuming for business, in resolving conflict situations, including with state bodies, it is necessary to use mediation procedures that allow you to find compromise solutions and avoid excessive financial and time costs," Vladimir Golovnev said.
Since 2014, working groups on pre-trial settlement of disputes have been held within the framework of the Expert Council under the Commissioner. Over 9 years of work, more than 110 cases have been considered. The effectiveness of mediation procedures is 85%.
In turn, issues related to disputes of economic entities that are not within the competence of the business Ombudsman are sent to the Mediation Center of the Moscow Region created on the initiative of the Commissioner in 2019. So, in 2022, the Center considered 523 appeals. In 95% of cases, it was possible to agree and reconcile the parties to the conflict.
In each specific situation, it is necessary to preserve the partnership and confidentiality of the conflict. It is important not only to conclude a mediation agreement, but also to use it by each party.
"The resolution of conflict situations through pre–trial settlement of disputes serves to develop entrepreneurship and strengthen the economy as a whole," concluded Vladimir Golovnev, the Commissioner for the Protection of the Rights of Entrepreneurs in the Moscow Region.
