Thanks to the assistance of the Business Ombudsman, two Moscow regional entrepreneurs have reduced the cadastral value of land plots.
Two had similar situations at once. They complained about the unjustified increase in the cadastral value of land plots to the Commissioner for the Protection of the Rights of Entrepreneurs in the Moscow Region Vladimir Golovnev.
The Business Ombudsman received appeals from two enterprises. In their appeals, business representatives complained that during the next assessment of the cadastral value of land plots, it was increased several times, which led to a significant increase in the financial burden on enterprises.
In order to fully and comprehensively consider these appeals, the Commissioner sent requests for information to the Ministry of Property Relations of the Moscow Region.
Based on the results of inspections conducted by the Ministry with the involvement of local self-government bodies, it was decided to correct errors in the assessment of the cadastral value of the applicants' land plots.
As a result of the recalculation, the cadastral value of one of the considered land plots was reduced by more than 40%, the second by 60%. The applicants believe that the newly established values correspond to the market value of the land plots.
The problem of erroneous determination of cadastral value is not new for the Commissioner, who is a member of the Commission for the Consideration of Disputes on the results of determining cadastral value at the Ministry of Property Relations of the Moscow Region. In 2022, the Commission considered more than 520 applications and made 208 positive decisions. Most of them were agricultural plots.
