The involvement of the Moscow Region Commissioner in the case helped the management of the JSC to win the trial.

The support of the Commissioner for the Protection of the Rights of Entrepreneurs in the Moscow Region in court helped the Joint-Stock Company to oblige the territorial administration of the Federal Agency for State Property Management in the Moscow Region to fulfill its obligations under the lease agreement.

In October 2021, a lease agreement for a state-owned building was concluded between the Territorial Administration of the Federal Agency for State Property Management in the Moscow Region and the Joint-Stock Company based on the results of the auction. Prior to the state registration in January 2022 of the rights of ownership and use of the building, the management of the JSC repeatedly notified the lessor of the presence of an obstacle in the passage – a concrete fence was installed on the adjacent territory around the perimeter.

 The territorial directorate of Rosimushchestvo neither before the state registration nor during 2022 took appropriate measures to eliminate obstacles in the use of leased property. Moreover, it has repeatedly sent claims about the need to sign the act of acceptance and transfer of the building without its actual transfer.

The joint-stock Company appealed to the Moscow Region Commissioner for the Protection of the Rights of Entrepreneurs with a complaint about the inaction of the Federal Property Management Agency, pointing out that it violates not only its rights under the lease agreement, but also clearly contradicts the interests of the Russian Federation.

The Federal Property Management Agency responded formally to the relevant request of the Business Ombudsman and appealed to the court with the requirement to terminate the lease agreement with the Joint-Stock Company.

Having disagreed with such a decision, the applicant, with the support of the Commissioner, appealed to the court with his own demands.

In May 2023 the Arbitration Court of the Moscow Region refused to satisfy the request of the Federal Property Management Agency to terminate the contract and satisfied the Company's counterclaims to fulfill its obligations established by the contract – to transfer the building according to the act of acceptance and transfer, indicating information about the technical condition of the object at the time of its transfer.

The appeal remains under the control of the Commissioner until its full consideration in subsequent judicial instances.
