Every fifth appeal received by the Moscow Business Ombudsman is related to the activities of law enforcement agencies.
An individual entrepreneur, engaged in trade, appealed to the Commissioner for the Protection of the Rights of Entrepreneurs in the Moscow Region Vladimir Golovnev with a complaint about the inaction of the police during the investigation of a criminal case.
A part of the non-residential premises that the entrepreneur uses for trading is leased from the entrepreneur. In April last year, unknown people broke into the store, seized it, blocking the way for the businessman and the hired employees.
Together with the premises, property belonging to the entrepreneur, money and financial and economic documentation were seized.
The entrepreneur applied for illegal actions to the local police station, as a result of which 2 criminal cases were initiated under articles Part 1 of Article 330 and paragraph "b" of Part 2 of Article 158 of the Criminal Code of the Russian Federation.
However, as the applicant indicated in his appeal to the Business Ombudsman, no investigative actions and operational search measures were carried out by the police to solve crimes. Moreover, these criminal cases were combined into one production, and according to the results of the investigation, the police decided to terminate them.
In order to protect the interests of the entrepreneur, the Commissioner appealed to the Prosecutor's office of the Moscow Region about the need for a prosecutor's check of police inaction during the investigation of a criminal case. As a result, the decision to terminate it was canceled, and the investigation was resumed.
Commenting on the situation, Vladimir Golovnev noted that appeals related to the activities of law enforcement agencies remain in the top three most common. So, since the beginning of 2023, 21% of all complaints received by the Business Ombudsman concerned this topic.
"We bring all appeals to a logical conclusion and resolve the problem. Entrepreneurs from the Moscow Region should feel protected and successfully develop their business," summed up the Commissioner for the Protection of the Rights of Entrepreneurs of the Moscow Region Vladimir Golovnev.
