A limited liability company from Karelia received the long-awaited payment of the contract after the intervention of the Commissioner for the Protection of the Rights of Entrepreneurs in the Moscow Region Vladimir Golovnev.
In December 2021, a municipal contract was concluded between the limited liability company and the administration of the Krasnogorsk city district for the performance of services for charging fees for renting residential premises and sending payment documents. The organization promptly sent documents to the customer confirming the performance of the work provided for in the contract.
Starting from March 2022, funds for services rendered have ceased to be credited to the organization's account. This forced the LLC to appeal to the Arbitration Court of the Moscow Region and to the Commissioner for the Protection of the Rights of Entrepreneurs on all controversial issues related to the execution of this municipal contract and compulsory debt collection. The Commissioner took part in court sessions as a third person who does not make independent claims.
The arbitration court satisfied the requirements of the company, and the actions of the administration were declared illegal.
The Company has again appealed to the Business Ombudsman with a complaint about the inaction of officials of the city district administration on the enforcement of decisions of the Arbitration Court of the Moscow Region that have entered into force.
The Business Ombudsman sent a letter to the Prosecutor's Office of the Moscow Region containing the arguments supported by the applicant, with a request to check the inaction of officials of the city district administration.
The entrepreneur notified the Business Ombudsman about the receipt in full of the funds awarded by the court decision.
