Thanks to the assistance of the Moscow Business Ombudsman, the dispute between the entrepreneur and the city administration was settled.
At the next meeting of the working group of the Expert Council under the Commissioner for the Protection of the Rights of Entrepreneurs in the Moscow Region, the appeal of the CEO of a limited liability company was considered.
The applicant appealed to Vladimir Golovnev with a request for assistance in obtaining an additional land plot under the real estate owned by the company.
During the meeting of the working group of the Expert Council, with the involvement of all interested parties, the circumstances that gave rise to the appeal were considered.
The applicant completed the construction and the store building in 2005. The development spot of the capital construction object does not correspond to the boundaries of the allocated land plot. The decisions on the allocation of an additional land plot to the applicant, adopted by local self-government bodies when issuing a construction permit, were not implemented. To date, it has not been possible to resolve the problem that has arisen, part of the store has "hung in the air".
Representatives of the Ministry of Property Relations of the Moscow Region and the administration of the city district reported on the possibility of redistributing land in order to increase the area of the land owned by the applicant.
The participants of the meeting noted the need to bring the type of permitted use of the land plot adjacent to the applicant's plot to ensure the possibility of land redistribution.
Following the results of the meeting, the applicant was recommended to contact the city district administration to receive municipal services for making changes to the rules of land use and development, as well as preparing and approving a land surveying project.
Until the issue is fully resolved, it remains under the control of the Commissioner.
