The CEO of the Joint-Stock Company appealed to the Commissioner for the Protection of the Rights of Entrepreneurs in the Moscow Region Vladimir Golovnev with a complaint about the failure of the municipal administration to execute a court decision that entered into force.

Due to the need to renew the right of permanent (indefinite) ownership of a land plot, the Joint-Stock Company applied to the city administration with an application for its ownership for a fee without bidding. However, the service was refused. The organization successfully challenged the refusal of the local government in court.

In accordance with the decision of the Arbitration Court of the Moscow Region, the refusal of the administration was declared illegal, and the municipal authorities were obliged to send the draft land purchase agreement to the company within 30 days.

But, even after the court decision came into force, the Joint-Stock Company again received a refusal from the administration.

Having studied the case materials and having seen a violation of the entrepreneur's rights, the Commissioner sent an appeal to the Prosecutor's office of the Moscow Region to take response measures.

According to the results of the prosecutor's inspection in connection with the revealed violations of the law, the city prosecutor's office submitted to the head of the city an idea about their elimination. A contract for the purchase and sale of a land plot has been concluded between a local government body and the Joint-Stock Company.
