Criminal cases were initiated after the intervention of the Moscow Business Ombudsman
Two individual entrepreneurs appealed to the Commissioner for the Protection of the Rights of Entrepreneurs in the Moscow Region with a complaint about the inaction of law enforcement agencies.
Entrepreneurs have concluded several contracts with a Limited Liability Company for the supply of goods. They fulfilled their contractual obligations in a timely manner – they delivered the goods, but they did not receive payment for the delivery. The office and production of the company were closed.
Businessmen appealed to the police with statements about the initiation of criminal cases, on the fact of committing illegal acts that caused significant material damage to the director of the LLC, but they were refused to initiate criminal cases.
The issue was discussed at a joint reception of the Commissioner for the Protection of the Rights of Entrepreneurs in the Moscow Region Vladimir Golovnev and the first deputy Prosecutor of the Moscow Region Andrei Gantsev. The participants of the meeting took the issue under control.
According to the results of the prosecutor's check on the statements of entrepreneurs, checks were carried out on the illegal actions of the CEO of the LLC, as a result of which criminal cases were initiated under part 4 of Article 159 of the Criminal Code of the Russian Federation.
According to the facts of the revealed violations of the criminal procedure legislation, committed during the pre-investigation checks, the measures of the prosecutor's response was taken to the head of the police department.
