The issue of recalculation of debt for utilities is under the control of the Business Ombudsman.
At a joint reception, that was held in September 2023, a businesman from Krasnogorsk city district complained to the Commissioner for the Protection of the Rights of Entrepreneurs in the Moscow Region Vladimir Golovnev and the prosecutor of the Moscow Region Sergey Zabaturin about the actions of a resource-supplying organization.
Since 2013, the entrepreneur has been the owner of non-residential premises in an apartment building, which he uses for an optics salon. All this time, the applicant paid for all utilities through management companies.
In October 2021, JSC “Vodokanal” notified the entrepreneur about the need to conclude a cold water supply contract, which he did in February 2022.
JSC "Vodokanal" recalculated the amount of utility resources provided (specifically for cold water) for the period from January 2017 to July 2021 and issued an invoice to the consumer, determined by the settlement method, in the amount of over 2,3 million rubles.
Moreover, without notifying the entrepreneur, the JSC filed a claim against him for debt collection in court, which resulted in a decision in absentia to recover the specified amount and state duty over 19 thousand rubles. After the entrepreneur's appeal to the Business Ombudsman and the Prosecutor of the Moscow Region, the Krasnogorsk City Prosecutor's Office, along with the applicant and representatives of “Vodokanal” JSC, held a meeting at which they considered the issue of recalculating debts and calculating fees for the supply of utility resources based on the readings of an individual metering device.
Currently, the process of adjusting the amount of debt for consumed resources is underway. The issue remains under the control of the Commissioner.
