With the assistance of the Business Ombudsman, the court ruled in favor of the entrepreneur.
The limited liability company defended its rights and legitimate interests by contacting the Commissioner for the Protection of the Rights of Entrepreneurs in the Moscow Region Vladimir Golovnev.
The business entity concluded a lease agreement with the administration for a state-owned land plot back in September 2005, and since then has repeatedly extended the lease term. In February 2023, the Company received a notice of an increase in rent by more than two times.
Without receiving clarification from the administration, LLC filed an administrative lawsuit against the administration and the Council of Deputies of the Dubna city district to invalidate certain provisions of the Decision of the Council of Deputies that increase the coefficients in the formula for calculating rent for land plots in the territory of the municipality.
For support in the lawsuit, the entrepreneur turned to the Business Ombudsman of the Moscow Region Vladimir Golovnev.
The Moscow Regional Court involved the Commissioner in the case as an interested person.
During the trial, it was found out that when the administration and the Council of Deputies established the disputed coefficients, the principle of economic justification for their increase was not observed.
By the decision of the Moscow Regional Court, the administrative claims of the LLC were satisfied – the normative legal act of the Council of Deputies regarding the establishment of corrective coefficients was declared invalid.
