Experts proposed to "bring to mind" the current legislation on taxes and fees.
Proposals for improving taxation and tax administration were discussed today by members of the Public Council under the Commissioner for the Protection of the Rights of Entrepreneurs in the Moscow Region within the walls of the State Public Scientific and Technical Library.
The participants of the meeting, including heads of higher educational institutions, members of business, public and law associations, as well as representatives of the Moscow Regional Duma, reviewed the initiatives published in the Commissioner's Annual Report for 2023.
"For 10 years, discussions on the problems of tax legislation and amendments to it have been continuing at various events and venues of the Presidential Commissioner for the Protection of the Rights of Entrepreneurs Boris Yuryevich Titov with the participation of regional commissioners. In the Moscow Region special cooperation has been established with the expert community, which analyzes and summarizes law enforcement practice, highlighting systemic legal and tax problems, and also develops recommendations for their resolution, including for government agencies" - said the Business Ombudsman Vladimir Golovnev.
Among the voiced proposals, there are both new editions of the current articles of the Tax Code, as well as additions concerning the principles of establishing and collecting taxes and fees, reasonable sufficiency of tax control and its integrity.
"Today, there is a clear bias of the Tax Code of the Russian Federation towards detailed regulations and instructions, rather than a system-forming legislative act. As a result, numerous conflicts, gaps and ambiguities in the Tax Code, especially in connection with constant changes, often entail an unnecessarily restrictive interpretation that violates the rights and legitimate interests of taxpayers. I would like to find optimal solutions for both the state and business, for example, in such a problematic issue as business fragmentation. So that this problem goes out of our lives and entrepreneurs can think about how to develop a business, and not how to survive," said Vadim Zaripov, the head of the practice of rulemaking and regulatory initiatives at MEF LEGAL company.
The members of the Public Council also discussed the problems of business fragmentation, the transitional regime and the need for comprehensive reform of tax legislation. The announced initiatives were generally supported, and in the near future, with amendments, will be sent to the relevant committee of the Moscow Regional Duma for further consideration.
