A company from Balashikha city district has been providing telecommunications services in for several years.
The Internet service provider was denied the placement of equipment in a new apartment complex. To protect his rights and legitimate interests, the entrepreneur turned to the Business Ombudsman of the Moscow Region Vladimir Golovnev.
According to Federal Law No. 67, dated on 06.04.2024 "On Amendments to Article 6 of the Federal Law "On Communications" and the Housing Code of the Russian Federation", a provider can place equipment in an apartment building to connect to its network at the request of only one of the tenants. Thus, the management company, which refused to place the equipment in the residential complex to the Internet provider, prevents competition in the access of telecom operators and infringes on the rights of homeowners, depriving them of the opportunity to independently choose the operator that best meets their needs and requests.
On behalf of the Commissioner for the Protection of the Rights of Entrepreneurs of the Moscow Region Vladimir Golovnev, the head of the public reception of the Ombudsman in the Balashikha city district Anatoly Shestakov, explained to the management company the requirements of the Federal Law "On Communications".
The issue has been resolved in favor of the telecommunications company.
