In 2021, concrete blocks appeared on a plot of land owned by an entrepreneur and located near the highway.
The owner of the commercial facility managed to establish that the structures are intended for the construction of a pedestrian crossing as part of the overhaul of the federal highway. However, he was not notified about the planned construction. Letters to various authorities remained unanswered.
For help, he turned to the Commissioner for the Protection of the Rights of Entrepreneurs in the Moscow Region Vladimir Golovnev. Despite the fact that disputes between business entities are not within the competence of the Business Ombudsman, a letter was sent to the Federal State Institution “Centravtomagistral”. The response explained that in the documents provided at the time of acceptance and transfer of the section of the federal highway, the elements specified in the letter are missing and are not listed on the balance sheet of the institution.
An entrepreneur has the right to use his land for its intended purpose.
