Members of the Moscow Center for Public Procedures "Business against Corruption" considered appeals on illegal criminal prosecution of business.
Complaints related to the illegal criminal prosecution of entrepreneurs from the Moscow Region were discussed at the next meeting of the Center for Public Procedures "Business against Corruption".
With the participation of Vladimir Golovnev, the Commissioner for the Protection of the Rights of Entrepreneurs in the Moscow Region, the lawyers reviewed 6 appeals.
So, in one of the cases, the investigation period is more than two years, while no one was detained, no one was charged, no preventive measure was chosen, the guilty person has not yet been identified. The investigation, in violation of Part 5 of Article 162 of the Criminal Procedure Code of the Russian Federation, uses an illegal, unjustified and arbitrary method of extending the investigation period, according to the circumstances of which the judicial practice of courts of various instances has been formed. As a result of the inaction of law enforcement agencies, the business almost went bankrupt.
In another case, the director of an enterprise engaged in emergency maintenance of gas meters in households, as well as high-pressure gas distribution stations, was accused of fraud and imprisoned. All accounting and constituent documentation of the organization was seized, and therefore, its work was paralyzed. At the same time, the applicant has doubts about the validity of the accusation: there is no information about the actual circumstances of the case (the absence of copies of the protocols of interrogations of victims and their statements to law enforcement agencies, interrogations of other accused in a criminal case, data on the appointment of appropriate examinations).
During the reception on these and other applications, the lawyers of the Center for Public Procedures "Business against Corruption" studied in detail the circumstances of all appeals, clarifying the details from entrepreneurs and their representatives.
"Our main task is to protect the rights of entrepreneurs from illegal actions by officials, from unjustified criminal prosecution, including related to raiding and unfair competition. At the meetings of the Center for Public Procedures, we consider the most difficult cases, like those that were announced today, and take a direct part in conflict resolution," said the Business Ombudsman Vladimir Golovnev.
He also noted that at the end of the meeting, all cases will be sent to the prosecutor's office of the Moscow Region to take measures of prosecutorial response.
