At a joint reception of the Commissioner for the Protection of the Rights of Entrepreneurs in the Moscow Region Vladimir Golovnev and the prosecutor of the Moscow Region Sergei Zabaturin, the issue of a company producing thermal insulation pipes, which complained about red tape committed by law enforcement agencies during the investigation of a criminal case, was considered.
The applicant's non-residential building suffered extensive property damage as a result of a fire that occurred on a neighboring plot.
It is not possible to draw an unambiguous conclusion from the expert opinion regarding the cause of the fire, and therefore the investigation of the case was suspended.
The Company was invited to a joint reception of the regional business Ombudsman and the prosecutor. As a result of the prosecutor's inspection, the decision to suspend the case was canceled and sent to the investigator for additional investigation.
Currently, the issue of conducting an additional examination of the cause of the fire is being resolved, and procedural actions are being carried out aimed at establishing the circumstances to be proved in accordance with article 73 of the Criminal Procedure Code of the Russian Federation.
In connection with the revealed violations of the criminal procedure legislation committed during the investigation of the criminal case, the Prosecutor's Office of the Moscow region submitted a submission to the head of the investigative department of the Ministry of Internal Affairs of Russia "Serpukhovskoye".
The appeal remains under the control of the Business Ombudsman.
