The General director of a commercial organization from Yekaterinburg appealed to the Commissioner for the Protection of the Rights of Entrepreneurs in the Moscow region, Vladimir Golovnev, with a complaint about the inaction of employees of the bailiff service in the Balashikha city district in initiating enforcement proceedings by court decision.

In March 2023, the Arbitration Court of the Moscow Region issued a court order to recover debts in favor of the applicant from a commercial organization registered in the city of Balashikha of the Moscow region. After that, the applicant sent an application to the bailiff service to initiate enforcement proceedings. No enforcement proceedings were initiated at the time prescribed by law. There were no results in response to repeated complaints sent to the service, as well as taking into account the decision taken by the Arbitration Court of the Moscow Region to recognize the inaction of the bailiff as illegal and the obligation to eliminate the violation. Having failed to obtain official duties from the bailiffs, the CEO of the commercial organization turned to the Commissioner. The Commissioner decided to send an appeal to the prosecutor's office of the Moscow region. Based on the results of the audit, the Prosecutor's Office submitted an idea to the Head of the Main Department of the FSSP of Russia for the Moscow region on the elimination of violations of the law. As a result of the measures taken, enforcement proceedings were initiated.
